She sent me the arc form for the Fence that also included some back and forth between kohn-ell and the homeowner. I'll attach it here.

Hey Brandis. This is the house that was having the party the other day and I submitted the complaint form and asked you to check on that deck that has been built without permission. What do we do about asking them to move their fence? We didn't approve it. They are supposed to get a city permit first. If the city gave them the permit and allowed it, who is at fault? I don't know how to handle this.

Hey Kristy, I did speak with the homeowner on the one your are speaking about and she said she did fill out the request but it wasn't ever told it was approved and went ahead and put it in the fence and did the patio thinking she could since it was like others in the community. I told her she cant do that and needs to send it in and one for the deck. We should get that soon.
All that being said once she sends it in you can ask for it be moved. As for the permits from the City the forms does say you should get the proper permitting but we don't manage that area that they do get them. The Arch comm. needs to make sure when approving the fences it is not on areas that will compromise these type of issues or on easements. Hope that helps. I got a letter in the mail on 03,16,2021 about a year after my fence has been up saying that my Architectural request has been denied for this reason: That I built the fence over a swale. So what am trying to say is when I built my fence I followed all the rules and proper guideline, and in this guideline, there was NOTTING in these guidelines that said anything about any SWALE are tell me that I cannot build the fence over it. So what is really the problem? because I feel like am renting this property and I don't appreciate it. I attach a copy of the guidelines that I followed.

Good afternoon, where can I find the information for the appeal process because I did see anything about, City Permit to put up a fence on my property. And if possible I would like a hearing with the Board and the City at the same time so someone can explain to me the harm my fence is causing.

When I had my fencing put in I follow the guidelines that was in the by-laws about putting up fences and there was noting included about in there about a swale. And also one of my neighbor in neighborhood did her fencing the same way and yes I spoke her. Whit all that said I do not think I violation thanks.

Other homeowner have there fencing the same way mine is, no one is sending them any letters or emails i know this because I ask them. And on the instruction document there was noting state on there about any swale the documents said i should fence in all my property and leave 6ft out and that is what we did ,so again can I PLEASE the information for the person In charge thanks.

Okay. Let’s first send them a warning letter. That their arc was denied because their fence is over the swale. And because they refuse to resubmit another arc form with Dimensions that will take the fence off of the swale and are refusing to move it off the swale, then we will report them to the city of Raleigh. I want an official letter on file first before contacting the city.
That’s when I contacted the city and the city said handle it thought the HOA. So I had Kohn-ell send them another warning letter.
